Tirupati Traders – Global Supplier of Sesame & Mustard Seeds

These Terms & Conditions (“Agreement”) govern all transactions between Tirupati Traders (“Seller,” “We,” or “Us”) and the Buyer (“You” or “Customer”) related to the sale and supply of Sesame Seeds, Mustard Seeds, and related agricultural products. By placing an order, you acknowledge and agree to the terms mentioned herein.

1. Product Specifications

All products are supplied as per agreed quality standards, grade, packaging, and moisture levels.

Any specific requirement must be communicated in writing before order confirmation.

Natural variations inherent to agricultural products may occur.

2. Pricing & Payment Terms

Prices are quoted FOB / CIF / CNF / Ex-Works, as mutually agreed.

Payment methods accepted: TT (Telegraphic Transfer), LC (Letter of Credit), or any mutually accepted instrument.

All bank charges outside India are to be borne by the Buyer.

Orders will be processed only after receipt of advance or LC confirmation, unless otherwise agreed.

3. Order Confirmation & Delivery

Orders are confirmed only after written acceptance by Tirupati Traders.

Delivery timelines are estimates and may vary due to port delays, customs clearance, or force majeure circumstances.

Risk transfers to the Buyer as per agreed Incoterms (Latest Version).

4. Inspection & Quality Claims

Goods are inspected before dispatch. Third-party inspection (e.g., SGS / Bureau Veritas) can be arranged at Buyer’s cost.

Any claim regarding quantity or quality must be raised within 7 days of receipt with proper documentation.

If the claim is verified, compensation or replacement will be mutually discussed.

5. Force Majeure

We shall not be liable for any delay or failure in performance due to events beyond our control, including but not limited to natural disasters, war, government restrictions, strikes, shipping delays, or pandemic situations.

6. Compliance & Certifications

Tirupati Traders adheres to phytosanitary regulations, food safety standards, and export guidelines of India.

Buyer must ensure that the imported goods comply with regulations of the destination country.

7. Limitation of Liability

Our liability is limited solely to the invoice value of the disputed goods. We are not responsible for indirect or consequential losses, including loss of profit.

8. Governing Law & Dispute Resolution

This Agreement is governed by the laws of India.

Any dispute shall be settled through amicable discussion, failing which it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, seated in Gwalior, MP, India.

Language of arbitration: English.

9. Confidentiality

Buyer agrees not to disclose pricing, documentation, or business information shared by Tirupati Traders to any third party without written consent.

10. Acceptance of Terms

By placing an order or engaging in trade with Tirupati Traders, the Buyer confirms acceptance of these Terms & Conditions.
